Terms of Service

These Terms of Service (“Terms”) govern your use of the Ethos mobile application and related services (the “App” or “Service”), provided by D3 Technology Group, LLC (“we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

who we are

eligibility

You must be at least 13 years old to use the App, and old enough to form a binding agreement in your jurisdiction. By using the App, you confirm that you meet these requirements. The App is not directed to children under 13.

your account

To use most features, you create an account using an identifier you provide (such as an email address or phone number) and a display name you choose. You are responsible for the activity that happens under your account and for keeping your access secure. You agree to provide accurate information and not to impersonate others or misrepresent your identity.

You may delete your account at any time from within the App, or by request as described in our Account Deletion page.

what ethos is

Ethos is a location-based, ephemeral social space. Content you share is intended to be visible to people near you and to remain available only for a limited time before it fades and is removed. Because of this design, content is generally transient by nature. You should not rely on the App to permanently store or preserve anything you post.

your content

You retain ownership of the content you create. By sharing content through the App, you grant us a limited, non-exclusive license to host, display, and distribute that content as needed to operate the Service — for example, to show it to nearby users for its lifespan. This license exists only to run the Service and ends when your content is removed, except for copies retained for safety or legal reasons as described below and in our Privacy Policy.

You are solely responsible for the content you share, and you confirm that you have the right to share it and that it does not violate these Terms or any law.

community guidelines — acceptable use

Ethos is meant to be a calm, local, human space. To keep it that way, you agree not to use the App to share content or behave in ways that include:

  • Harassment, bullying, threats, or targeting of any person or group.
  • Hate speech or content that demeans people based on identity, including race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics.
  • Sexual content involving minors, or any content that exploits or endangers children. This is strictly prohibited and will be reported to authorities where required.
  • Sexually explicit or pornographic content.
  • Violence, incitement of violence, or promotion of self-harm.
  • Illegal content, or content that facilitates illegal activity.
  • Spam, scams, deceptive content, or unsolicited promotion.
  • Sharing other people’s private information without consent.
  • Impersonation, or attempts to deceive others about who you are.
  • Attempts to disrupt, abuse, reverse engineer, or gain unauthorized access to the Service or other users’ accounts.

These guidelines apply to everything shared through the App, including private interactions. Use good judgment and treat the people around you with respect.

reporting & enforcement

The App provides tools to report content or users and to block other users. When content is reported, we may review it — including preserving a copy for review — and take action we consider appropriate.

We may, at our discretion, remove content, limit functionality, or suspend or terminate accounts that violate these Terms or our community guidelines, with or without notice. We may also retain limited information related to violations for safety, abuse prevention, and legal compliance, as described in our Privacy Policy.

privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we handle and how. Please review it to understand our data practices.

service availability & changes

The App is provided on an “as is” and “as available” basis. We are an independent, early-stage service, and we may add, change, suspend, or discontinue features — or the Service itself — at any time. We do not guarantee that the App will always be available, uninterrupted, or error-free.

disclaimers

To the fullest extent permitted by law, the App and Service are provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your expectations, that content shared by others is accurate or appropriate, or that the Service will be secure or error-free. You use the App at your own discretion and risk.

limitation of liability

To the fullest extent permitted by law, D3 Technology Group, LLC and its members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, it is limited to the maximum extent permitted by law.

indemnification

You agree to indemnify and hold harmless D3 Technology Group, LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your content, or your violation of these Terms or any law or the rights of another.

termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or our community guidelines, or for other legitimate operational, legal, or safety reasons. Provisions that by their nature should survive termination — such as content licenses for retained copies, disclaimers, limitation of liability, and indemnification — will survive.

governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any disputes will be subject to the jurisdiction of the courts located in Texas, unless otherwise required by applicable law.

changes to these terms

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above. Your continued use of the App after updated Terms take effect constitutes your acceptance of the changes.
